January Legal Update & Luncheon

Sponsored by:

Legal Hour

10:15 am - 11:15 am

Speaker:  Patricia Davidson
Topic:  DOL’s Nationwide PAID Pilot Program – Is it Right for You?

Come to the January 2019 Legal Hour and hear first-hand from Keith Sonderling about the benefits of the U.S. Department of Labor’s PAID program.  Keith, an attorney, works in Washington, D.C. as the Senior Policy Advisor for DOL’s Wage and Hour Division. Keith will discuss the benefits of the PAID pilot program, which allows employers to cooperate with DOL to voluntarily settle overtime and minimum wage violations under the Fair Labor Standards Act.  The Payroll Audit Independent Determination (PAID) launched in March 2018.  The pilot program was originally slated to last only 6 months but, according to DOL, it has been so well received by both employers and employees that it has been extended for another 6 months. Under PAID, employers who self-report may work in good faith with DOL to correct mistakes and provide due compensation to their employees.   By participating, employers can avoid liquidated damages and civil money penalties.  Not all employers are eligible to participate in PAID, and the program has detractors in both employee and employer camps.  This is a unique opportunity to learn more about the program and evaluate the pros and cons of PAID from both a legal and HR perspective.
